MILWAUKEE - A 22-year-old mother from Milwaukee is charged with first-degree reckless homicide in the death of her 7-day-old son.
According to the criminal complaint, Brandy Payne got upset with the baby's father, who told her he didn't want to help with the baby, and that he didn't think the baby was his.
Payne then allegedly raised the baby above her head and threw him to the kitchen floor.
The baby had numerous skull fractures and hemorrhaging on the brain.
She saw his head was badly injured but did not take him to the hospital because, she said, she was so scared.
Instead, she put a cap on his head and took him to the father's family.
The family noticed the baby was badly hurt and called 911. He was rushed to the hospital, but doctors were not able to save him. The baby died of blunt force trauma to the head.
Payne faces up to 60 years in prison if convicted.
Michael Johnson is the baby's father, and he claims the allegations against Payne are not true.
"If I had any doubt that she did it, I'd tell you right now. I know for a fact that she did not harm this baby," said Johnson.
When asked about whether he was angry at her, Johnson told TODAY'S TMJ4's Yona Gavino "I'm not mad. I want to see her right now. She's probably devastated."
He said the last text she sent him was "love you. Call you in the morning."
The father's cousin said he didn't want to be identified, but he says he never saw the couple argue.
