Public statement to be issued 'shortly' in Darius Simmons homicide investigation

MILWAUKEE- The Milwaukee Fire and Police Commission was expected to discuss the way police handled the shooting death of a 13-year-old boy Thursday night.  But the boy's family walked away from the meeting without answers.

Patricia Larry's son Darius Simmons was shot and killed by their neighbor, John Spooner, who thought the unarmed teen had previously broken into his house.

Police kept Larry in a squad car for questioning, and away from her son as he died at the hospital.

On the agenda at Thursday's meeting, a public statement regarding the investigation.

"We have authorized executive director Tobin to finalize and release a report to the public and that will be released shortly," says the Fire and Police Commission's commissioner Sarah Morgan.

That's all the board had to say about it.  Larry didn't say a thing then, but did make a statement.  When the board opened the meeting up for comment, Larry stood up and left.

"She's hoping there's going to be, maybe sometime finally an apology," says Larry's attorney Jonathan Safran.  "I think many of us anticipated that the Darius Simmons public statement would be available and there would be some discussion tonight."

The commission wouldn't elaborate on what they meant by the report coming out "shortly" but it could come out as early as Friday.
