Smith Co. Fired Miners Settle Discrimination Case

CARTHAGE, Tenn. (AP) - Two Smith County miners have settled a discrimination case claiming they were fired after complaining about mine safety.

The U.S. Department of Labor's Mine Safety and Health Administration said the miners will get will get back wages, front pay and damages from Nyrstar Tennessee Mines -- Gordonsville. Nyrstar operates the Cumberland and Elmwood/Gordonsville mines in Smith County.

The discrimination complaint claims the two workers were fired for engaging in protected activities. Those activities include complaining about safety concerns and retaliation, registering with MSHA as designated representatives of miners and assisting MSHA with inspections.

The mine operator also must pay civil penalties totaling $22,000. And the company is required to read the settlement to workers at the two Tennessee mines and post a copy in the mines for nine months.
