FOND DU LAC-- Two women police say are involved in the disappearance of a Fond Du Lac man will remain behind bars.
Sisters Eve Nance and Tina Ewell are being held in connection with the disappearance of Eve's husband Timothy Nance from Fond Du Lac. Nance was last seen November 1st, his wife reported him missing a few days later. Eve Nance and her sister were arrested November 20 in connection with Nance's disappearance.
Six days after their arrests, the sisters filed a lawsuit alleging the district attorney and sheriff's department were holding the women too long without formally charging them. The judge ruled Wednesday the state did have sufficient probable cause to hold the pair on potential charges of hiding or mutilating a corpse and obstruction. The judge set a high cash bond for both women. Nance's bond was set at $100,000 cash and Ewell's was $50,000 cash.
It was standing room only in the courtroom as the sisters appeared in court via video-conferencing from jail. An attorney for the sisters argued their rights have been compromised and they should be released. "This appears to be a major fishing expedition," said public defender Mary Wolfe. "I think the state is casting their net quite wide with search warrants and with analysis but nothing specific to these two ladies."
The judge disagreed, saying the women are facing felony charges in a delicate and complex investigation.
"I can assure her and assure the public and assure everybody this is no fishing expedition this is serious a lot has been undertaken," said Judge Richard Nuss.
Outside the courtroom, emotions ran high as the victim's longtime frriend spoke out.
"I don't point fingers at nobody, I let the police do their job and I'm not mad at nobody, but he needs to be found," said Rodney Emerson. "Seven days they been jailed, I don't know if they did it or they didn't do it, OK, he' s been missing for 27 days."
The women will appear in court again for a status update on December 4th. The district attorney would not say if charges would be filed by that date.
