GREEN BAY, Wis. -- Police in Green Bay have arrested a man on charges of 1st Degree Reckless Homicide in connection with the death of a two-year-old boy.
Nicholas Willies turned himself into authorities Thursday afternoon after a warrant was filed for his arrest. In addition to the homicide charge, Willies faces Child Neglect Resulting in Death and two counts of Physical Abuse to a Child.
Willies made his initial appearance in Brown County Court Friday afternoon, where bond is set at $100,000.
According to the Green Bay Police Department, two-year-old, Alex Fountain, was taken to St. Vincent Hospital on January 7th after he had stopped breathing.
“The Brown County Medical Examiner's office was contacted about suspicious bruises and abrasions were observed on several areas of Alex's body,” said Lt. Kevin Warych, Green Bay Police Dept.
After further investigation, police explain continued abuse lead to the death of the two-year-old.
On the night of Jan. 7, Alex and another child were left in the care of their mother's boyfriend, Willies, who she had been dating for a few months.
Witnesses who frequently visited the home say they quote "saw Willies punch Alex in the stomach a bunch of times". That witness also stated, the kids were “deathly afraid of Nick.”
That night Willies took the boy into the bathroom, when he later came out and said they needed to go to the hospital because Alex wasn't breathing.
According to the complaint, Fountain died from an injury to the head, and peritonitis, infection of the abdomen, from punches to the stomach area.
On March 25, Willies admitted he punched baby, but was just playing around, and never intended harm. He arrested for Child Neglect Resulting in Death. Willies was released from custody so the Green Bay Police Department could continue its investigation.
On May 1, an arrest warrant was issued, the following day, Willies turned himself in.
Green Bay police wouldn’t comment on whether the mother, Juanita Fountain, would be charged in connection with this case, but added she is being cooperative.
The other child in the home has been removed from the mother’s custody.
