Durango student claims he was expelled for appearing in nearly nude photo

Las Vegas, NV (KTNV) -- A student caught on camera next to a nearly nude girl in the hallways at Durango High School said he was expelled for being in the wrong place at the wrong time.
Gary Hoffmann is visible in pictures standing with his crutches next to the girl. Hoffmann said he didn't take any pictures, nor did he encourage the girl to strip.
But after the photo spread like wildfire on social media, Hoffman said he received a letter from school administrators notifying him he had been expelled.
"I feel that it's wrong. I don't feel like I should be punished in any way just because I am in the picture," said Hoffman.
His mother Angel said the school went too far with the punishment, and that the proof is in the picture.
"You can see him clearly looking away," said Angel Hoffmann. "He's looking down, he's not even looking in their direction. He is not a part of the group, he's the one standing by himself in the back."
Because of privacy laws, Clark County School District leaders could not comment about this incident. However, they said in instances like this one, a thorough investigation is conducted before any disciplinary action is taken.
The Hoffmanns plan on fighting the school's decision.
