DUI alleged in deadly Vegas CHP officer crash
LAS VEGAS (AP) -- Prosecutors in Las Vegas have added driving under the influence causing death charges to murder and other counts against a California man accused of stealing an off-duty California Highway Patrol officer's pickup truck and crashing it, killing the officer and a relative when they tried to stop him.
Prosecutor Michael Staudaher said Thursday that 29-year-old James Robert Montgomery's blood-alcohol percentage was 0.197. That's almost 2 1/2 times the legal limit.
A judge postponed a preliminary hearing until Oct. 4 after the additional charges were filed.
The Aug. 18 crash killed veteran CHP Officer Jesus Manuel Magdaleno Jr. and Magdaleno's brother-in-law, Felix Brandon Cruz III.
Montgomery is also accused of kidnapping, robbery, burglary and auto theft.
His lawyer, Michael Becker, said he thinks someone may have slipped Montgomery a drug.
