Jury selection progressing in Las Vegas hep C case

CREATED May 1, 2013

LAS VEGAS (AP) -- Prosecutors and defense attorneys are getting close to seating a jury for the criminal trial of a former endoscopy clinic owner and an employee accused of causing a 2007 Las Vegas hepatitis C outbreak.

Questioning of prospective jurors continues Wednesday after resuming Friday. That's the day a Nevada Supreme Court panel decided not to stop proceedings.

Lawyers for Dr. Dipak Desai say he's too incapacitated by strokes to assist in his defense.

Prosecutors allege that Desai is exaggerating his ailments.

Desai and former nurse-anesthetist Ronald Lakeman have pleaded not guilty to charges including murder, fraud and criminal neglect of patients.

Health officials determined nine people contracted incurable hepatitis C in 2007 at a Desai clinic. One later died.

Once trial starts, it is expected to take several weeks.
