Las Vegas, NV (KTNV) -- The Nevada state legislature released a statement on Tuesday saying it will go on as planned, with or without Brooks.
Brooks is accused of threatening assembly speaker Marilyn Kirkpatrick.
His attorney said Tuesday his client never made such threats, and said a lack of any current charges speaks to Brooks' innocence.
Mitchell Posi also talked about the North Las Vegas Police Department's decision to review previous reports.
"When you've turned someone's life upside down like this and caused such devastation in your wake, it's a day late and a dollar short to say 'oops, we'll go back and see where we made a mistake,'" Posi said.
Posi said Brooks remains at an area hospital.
