Ex-employee to appeal ruling in Las Vegas hep C case

LAS VEGAS (AP) -- A defense attorney says he'll appeal a Nevada state judge's decision to let a murder charge stand against an ex-employee facing trial with a former Las Vegas physician and clinic owner on criminal charges stemming from a 2007 hepatitis C outbreak.

Attorney Frederick Santacroce said Friday he'll tell the Nevada Supreme Court that former nurse anesthetist Ronald Lakeman had nothing to do with outpatient procedures that prosecutors say led to the death last April of Rodolfo Meana in the Philippines.

Clark County District Court Judge Valerie Adair's ruling on Lakeman's case came Thursday, a month after she refused to dismiss a murder charge against former doctor and clinic owner Dipak Desai.

Meanwhile, Desai's defense attorney is again raising questions about whether Desai is physically competent to stand trial.
