Judge denies city's motion to dismiss Onion appeal

Las Vegas, NV (KTNV) -- Onion, the dog that killed a one-year old Henderson boy in April, is still being held by the city of Henderson.

The Nevada Supreme Court denied a motion by the city to have the case dismissed on Friday.

The supreme court re-enforced the stay and says nothing should be done with the dog until the court rules on a petition by a group trying to save the dog.

Onion's owner gave him up and wanted him put to sleep. The New York-based Lexus Project wants to take Onion to an animal sanctuary in Colorado.

The 6-year-old mastiff-Rhodesian Ridgeback mix killed the little boy on his birthday -- April 28, 2011.

The dog is currently in the custody of the Henderson Animal Control.
