Woman arrested months after confessing to strangling boyfriend

CREATED Aug. 17, 2012

Henderson, NV (KTNV) -- Months after admitting to police she strangled her boyfriend, 36-year-old Tammy Lucero has been arrested and charged with murder.

Lucero claims he killed her boyfriend, David Hudson, in self defense.

Channel 13 Action News Legal Analyst Al Lasso said it's an unusual case because the suspect wasn't charged until nearly three months after the alleged crime.

Hudson was found dead in couple's apartment on May 24.

"It is unusual," said Lasso. "Usually you're charged with murder right away. For [the District Attorney] to wait almost three months to charge her with murder... it's a very good case, it sounds, for the defense."

According to the arrest warrant, Lucero told police her boyfriend punched her in the mouth and then tried to strangle her.

She also told police, Hudson challenged her by saying "Go ahead. I'm a gangster. I'm not afraid to die."

That's when, according to paperwork, Lucero used a computer cord to strangle Hudson.

She tells police it was in self defense and feared Hudson would "beat or kill her if she let go."

Neighbors at the apartment complex where the couple lived, say both parties were abusive.

One neighbor who spoke to Action News, says Hudson was the real abuse victim and that Hudson was afraid of his girlfriend.

Legal analyst, Al Lasso, says the case will ultimately come down to pre-meditation versus last resort.

"Even if there was domestic violence back and forth in this relationship, if she felt the only way out was to kill him (and there can be expert testimony to that regard) she could be walking out a free woman," says Lasso.

Lucero is being held in the Henderson Jail with no bond.
