PALM SPRINGS - If the Homeowners Association comes into your home to repair something, but damages your home in the process, who is responsible to fix that damage?
In most cases, it's the homeowners themselves, just like Douglas Qualls of Palm Springs. He had a water leak in his ceiling, so the property management at his Pointe Escoba Complex sent out someone to fix it. The repair was done, but they left behind a big hole in the ceiling exposing the water pipes.
"I called them and asked them if they were going to come out and repair that hole because they did before and they told me we don't do that," said Qualls.
The manager of the complex, Connie Buckley, said the owner is responsible for the dry-wall damage. She said they follow all regulations from the Homeowners Association at Pointe Escoba. According to the CC and R's, each owner is responsible for the maintenance and repair for his or her unit including interior walls and ceilings.
"They all say it's the CC and Rs, we can't violate those, but there's an exception to every rule," expressed Qualls.
The president of the HOA board at the complex, Paul Thompson, said the HOA is only responsible for the exterior of the homes; however, Qualls said the leak repair in his home is an unfinished job.
"It's not the end of the world. It's not that big a deal, but you know I can't feel that fair is fair, and I think they should be responsible for that," shared Qualls.
Other than the hole in his ceiling, he has no other problems with his current living situation.
"This complex is wonderful. It's well-managed. So far I have no real complaints, I'm just kind of surprised by this because it's so strange," said Qualls.
The manager of the complex said each property is different, and homeowners with an HOA really should check their individual codes to find out what they're responsbile for, and what they can expect their HOA to repair.
