No charges filed yet in Boise dog shooting

A Sunday morning walk in a boise neighborhood ended with a German shepherd shot. A couple walking two dogs were approached by a German shepherd. Witnesses say the dog was not acting aggressively, but the couple felt threatened, and the man reacted by pulling his gun and shooting the dog.
The couple, who spoke with us but declined to go on camera, say the german shepherd was acting aggressively, even biting at their ankles. The man shot the dog, and was attempting to hold her down when the owner came running out.
According to the dog's owner, Dalia's not an aggressive dog.
"People just have shepherds in general, and I think that's kind of wrong you know. German shepherds aren't these vicious dogs that people take them to be," he said.
Dalia is an 80-pound dog. Her owner had just been opening the garage door to take her for a ride in the car. Witnesses say that's when Dalia saw the other dogs, and ran over, they say, to play.
To shoot a dog like that, I just can't see understand why the man did what he did. I mean, she was in no fighting stance, she didn't want to hurt them," Dalia's owner said.
Neighbors say the dog has been seen in the neighborhood off of her leash before, but have had no complaints. Dalia was shot behind her shoulder blade. When her owners got to her, she was already losing a lot of blood. Idaho law says, if a person feels threatened by an animal at large, they have the right to defend themselves, even if that means using deadly force. The law goes on to say the owners of the dog can't sue that person for loss of their animal for taking that action.
"You almost don't have hope for people really if shooing the dog away would like, "Get out of here!" I mean that's really all it was. And none of that happened. None of that took place. He had no effort. His first Instinct for him was to pull out a gun and shot the dog," the owner said.
Police are still investigating this case. We spoke with Harrison Sunday evening, and it looks like Dalia will pull through. The case will be sent to the prosecutors office to determine if any charges will be filed.
