TUCSON (KGUN9-TV) - 9OYS obtained an interim complaint that offers a first real look at why Art Slatin says he stabbed his wife to death, while three of the couple's children waited in the car.
Art Slatin told police his wife "took a kitchen knife" and lunged at him. In a court interim complaint, he describes a struggle. He was "on top of her" "holding her hands" while she tried "to stab him with the knife." Slatin admits he stabbed here "2 times in the throat" "in hopes of stopping the attack against him."
"If what he says is true, that he was attacked with a knife and is fighting to save his life, you're allowed to defend yourself," said criminal defense attorney Mike Piccarreta.
Piccarreta says if the case moves forward. Prosecutors will have to prove it wasn't self defense.
"They're going to try and get to the bottom of it," said Piccarreta.
But the details make it complicated. His wife had multiple stab wounds to the chest as well. Slatin says he "cannot recall" how she received those wounds.
"When these things happen, they unfold very fast," said Piccarreta. "A person isn't required to wound another in the leg or in the arm to have self defense."
In other words, you're allowed to take lethal action. As for how this case will play out, Piccarreta says it's too early to know for sure.
"I would not base my assessment of the case on two paragraphs police write after the arrest," said Piccarreta. "He may have a good self defense case. He may not. But it will be based on totality of evidence, not a two paragraph summary."
Slatin sits in the Pima County Jail on $50,000 bond. He is facing second-degree murder charges.
