Farmer sues Chandler to keep rabbits off his land

CREATED Jul. 19, 2013

PHOENIX (AP) - A Chandler farmer is suing the city, saying rabbits from a park are damaging his crops.
Jeff Foshee Farms filed the lawsuit in Maricopa County Superior Court asking the city to pay unspecified compensatory damages and court costs.
The Arizona Republic reports that the suit also seeks a court order to require Chandler to install a barrier to keep the rabbits off the 40-acre farm.
A lawyer for Foshee says the rabbit-caused damage cost the farm about $4,600 from March 2012 through this February.
The city has denied the allegations and says the farm owners didn't exhaust other remedies before filing suit.
They also say the area was designated for a future park and the farm owners assumed the risk of buying land near the park.
