TUCSON (KGUN9-TV) - The attorney for a Tucson police officer demoted for sending sexually explicit material to a coworker says that coworker violated her privacy, leaving her to pay the price.
An investigation by TPD found former Lieutenant, now Sergeant, Diana Lopez took racy pictures and video of herself, and sent them to a lower ranking officer with whom she had a relationship.
Lopez's attorney Mike Piccarreta says his client is considering suing the department and the city, adding TPD's policy on such behavior is extremely vague.
"You can't say afterwards, 'oh! You violated the rule. You didn't live an unsullied life, or you didn't have conduct unbecoming of an officer.' I mean that's as smushy of a standard as there is."
He adds, in this digital age, the case teaches a sad lesson.
"You have two choices. You can go through your life, trust no one. Or B: you can engage in relationships with people you care about, but you run the risk of betrayal."
TPD released a written reponse to Piccarreta's remarks.
It reads in part...
"The allegations were sustained as a result of the investigation, and the involved on parties were disciplined according to City of Tucson and Tucson Police Department policies. ...it would be inappropriate for the Tucson Police Department to provide further comment."
