Candidate qualifying controversy goes to court

FORT MYERS, Fla.- A local judge has kicked a political hot-potato up to a Tallahassee court room. 

Democrat Larry Aguilar has gone to court to challenge the state elections department which won't allow him on the ballot. 
 
Aguilar wants to run against incumbent Republican Matt Caldwell for a state house seat. 
 
Judge Kyle wouldn't hear the merits of the case because the Florida Secretary of State, who heads the elections department,  filed a motion requesting the case be heard in Tallahassee.
 
The judge agreed.
 
Aguilar has certified mail receipts showing his application for state house representative made it on time.  
 
Aguilar even has a letter from the elections office saying his check was received the day before the deadline.
 
While Aguilar remains in limbo, unable to raise money for his campaign, he says the states tactics are nothing less then voter suppression.
