FORT MYERS, Fla. - Many of us have locked our keys out of our car at some point, warranting a call to the tow copany for help. But a Fort Myers woman said a big mix-up has left her car damaged and the company who she believes is responsible, denying it.
April Dodson said she had her new 2013 Kia Soul for a month before a tow truck driver came to the door of her home and told her he had unlocked her car. Dodson, confused, said she never requested a lockout on her car.
She said the tow driver admitted he unlocked the wrong car, and gave her an "A Budget Towing" business card, with the words "Wrong Lockout Kia" written on the back with the name "Mark." Dodson said she went outside, only to discover her car was damaged.
"There's a dent on the door with scratches, down [the] side you've got a knick out the back door," Dodson said. "There's a gap where the door won't shut all the way."
Dodson said she spoke with the tow company's owner on Thursday, Friday and Saturday about the issue.
"He basically told me they do their lockouts on the passenger side, it could not possibly have been them and they refused to fix the car," Dodson said.
When Fox 4 went to get answers from the owner of "A Budget Towing" today, the owner said he never talked with any customer about a wrong lockout and refused an on-camera interview.
When asked how confident she is that this company caused the damage, Dodson said, "I'm 100 percent confident, I look at that door everyday there was no damage done to it that morning when I left."
Attorney Andrew Epstein said Dodson has a right to request the company pay for her damages.
"She needs to go out and ask them to fix it, if they refuse to fix it, she goes and has it fixed herself, then turns to them asking them to reimburse her for her damages," Epstein said.
If the company still refused to pay, the situation becomes a "he said, she said" situation, and a judge makes a decision based on whose case is more believable.
Dodson said she plans to take the company to court if it comes down to it. "A Budget Towing," has a Better Business Bureau Rating of an "A."
