FORT MYERS, Fla. - A Lee County jury found Yousel Rivera guilty in the attempted murder of Cape Coral police officer David Wagoner today. Rivera faces a life sentence for shooting the 45-year-old Wagoner during a traffic stop on April 11, 2011.
Wagoner testified during the trial explaining what he saw the night he came face-to-face with the barrel of a gun.
"I saw the firearm coming out from the left hand, concealed right out, coming out with a flash, coming out at the muzzle, right at me," he remembered. Wagoner was hit but survived his wounds.
It took the jury just 90 minutes of deliberation to return its verdict of guilty of first degree attempted murder of a law enforcement officer.
Rivera's sentencing is set for September 16th.
