FOX4 was focusing on people who were putting it all out there. What most people usually to do only in private, they also do in public! And they often get arrested for it! But keeping them behind bars is harder than you might think. All of what you are about to see happened here, in Southwest Florida, just in the last year.
It's happening in preserves, parks, parking lots! Of malls, stores, even hospitals! Not only are they doing this repulsive deed outside, but they're also doing it inside, in aisle three. And in restaurants where they're giving a new meaning to the phrase "under the table".
"My first reaction would be to probably tackle the guy and probably slam his head against the ground a couple of times," said Michael Stinnet, a father who frequently takes his daughter to the playground to swing on the swing set. He was disturbed to hear what had happened just a few feet from where he swings his daughter. "People like that need to be locked up for a very long time."
Several parents had noticed a man sitting on this park bench for several hours. Finally, one of the dads decided to come check on him to see if he's okay. As he approached like this he noticed that the man had his zipper undone, his privates were exposed and that he was masturbating
"They lack the foresight to stop themselves and say 'well, there's
consequences for my behaviors' ," says Dr. Mable Lopez who’s a psychologist with the Mind and Brain Center of Fort Myers.
But, are there? If they're arrested they typically say this; "Their defense is that's not, it's not what it looks like," says Matt Roepstorff, an Assistant State Attorney in Lee County. "Even if their pants were pulled up or down or obviously something is exposed and someone sees the genitalia or something exposed, whatever they were doing.....It's not what you think"
Later in court, that's what this guy said too. Our video shows a man in a surveillance video from last August doing what appears to be masturbating in an aisle in a department store. The video was used as evidence in a court case. "You can see him on the video, he's looking around presumably making sure no one else is watching him," adds Roepstorff.
It's obvious his privates were completely exposed but when it came time for court he had an explanation. "He actually called in a doctor at trial to testify that he had been suffering from some kind of rash or razor burn in that area," explains Roepstorff. "What witnesses thought was masturbating he called it either relieving himself or scratching the area."
It worked too! The man won! "I think the jury felt that he genuinely thought no one else was watching him even though there were security cameras up there,” Roepstorff mused.
"The higher risk the situation the more arousing it is for them and they're willing to take that risk for that pleasure, for that moment of pleasure,” says Lopez.
By now, you've got to be asking yourself- Why? Why would someone do something like that in public?
"There could be damage to the brain systems such as individuals that have been in a car accident and have had a traumatic brain injury or individuals that through disease such as dymensia lose their inhibitions," explained Lopez. But what about the cases where brain injury is ruled out? "The individuals that are intact mentally may know that this is inappropriate and even the idea that it is inappropriate is what leads them to do it. It won't stop them. It will actually be something that will propel them to do the behavior further."
Interestingly enough, most of these people do not have much of a criminal record although many of them get caught doing that more than once.
