No charges against Punta Gorda mother for infant death

PUNTA GORDA, Fla. - Jessica Smallwood will not face charges in connection with the death of her new born baby discovered by Punta Gorda police packed in a garbage bag inside a freezer.

The State Attorney's Office decided not to pursue charges against the 27-year-old based on the findings of the autopsy.

Police investigated Smallwood after receiving a call on January 29th that she had been transported to the Peace River Medical Center where doctors determined she had delivered a full-term baby.

Smallwood denied delivering a child and claimed she had flushed a blood clot down the toilet.

Investigators armed with a search warrant found an 18 inch, six and a half pound third trimester female fetus in the freezer of Smallwood's. 

The Punta Gorda Police Department revealed that an autopsy detected traces of cocaine in the fetus' blood.  The final autopsy determined that the fetus never took a breath.
